What no tax on tips and overtime means in the law
What they say
Lawler described the tax package as providing no tax on tips and no tax on overtime.
What the record shows ·
Sections 70201 and 70202 create federal income-tax deductions for qualified tips and qualified overtime for 2025-2028, available to itemizers and non-itemizers. Tips are capped at $25,000 per return; overtime at $12,500, or $25,000 jointly. Each deduction is reduced by $100 for each $1,000 of modified adjusted gross income above $150,000, or $300,000 jointly. Qualified overtime is the FLSA-required premium above regular pay, generally the extra half in time-and-a-half. Tips must meet occupation, voluntary-payment, reporting and other statutory conditions. Married taxpayers must file jointly and qualifying Social Security numbers are required.
Why there is no assessment here
These are conditional, temporary federal deductions. The literal no-tax wording does not establish elimination of every tax on every tip or all pay earned during overtime hours. Payroll taxes, state treatment and each taxpayer’s final liability are separate questions.
